PUBLIC NOTICE

Promulgation of Workers Compensation Regulations 2023

This is to notify the general public and all interested parties that the Workers Compensation Regulations 2023 are hereby promulgated, pursuant to Sections 104 and 107 of the Marshall Islands Administrative Procedures (“APA”) Act.

 

  1. Authority
    The authority to prescribe these regulations is vested in the Marshall Islands Social Security Board of Directors (“Workers Compensation Board”) pursuant to Section 740 of the Workers Compensation Act 2019.
  2. Notice
    Workers Compensation Board (MISSA Administration) shall give at least thiffy (30) days’ notice of a proposed rule for public comments at the Chief Secretary’s office, the High Court, and publish in the radio and newspaper.
  3. Publication
    Upon promulgation of the regulations, certified copies of the full text will be distributed by the Secretary of Internal Affairs to all Local government areas, pursuant to Section 107 of the APA.
  4. Summary
    Except as otherwise specifically provided, the Workers’ Compensation Board may make rules and regulations in conformance with the Workers Compensation Act. Regulations provide procedures and criteria for the effective implementation of the Workers Compensation Act of 2019.

It was a night full of heartwarming tribute, gift giving and karaoke singing for the man behind the exemplary accomplishments of the Workers’ Compensation Task Force and MISSA, Adrian Nippress.

After several years of deferment, the Nitijela of the Marshall Islands has finally passed Bill 95ND1 on March 24, 2023, also known as the Workers’ Compensation (Amendment Act) 2023.

At its meeting on November 16, 2022, the Cabinet has appointed Dr. Robert Maddison (MoHH), Ms. Helen Jetnil-David (Medical Travel Referral) and Mr. Joseph Tibon (Deputy Commissioner PSC) as additional members of the Workers’ Compensation Task Force (WCTF).

On March 21, 2022, Australian Ambassador Brek Bratley and MISSA’s Acting Administrator Bryan Edejer have signed the terms of reference for the Australian workers’ compensation adviser who is being provided by the Australian Government at no cost to MISSA.

Workers & Dependents of Deceased Workers

  1. Notify the WC Administration of your injury and request for medical treatment.
  2. File a claim for workers compensation.
  3. Submit additional documentation.
  4. Apply for lump-sum benefit.
  5. Report employer or insurance carrier failure to pay.
  6. Contest denied claim.
  7. Apply for permanent total disability.
  8. Authorize the release of your medical record and personal information.

Employers

  1. Apply for exemption to coverage
  2. Apply for self-insurance
  3. Notify the WC Administrator of your Workers’ Compensation insurance coverage
  4. Authorize the medical examination & treatment of your injured/ill worker
  5. Notify the WC Administrator of your worker’s injury, illness or death
  6. Contest approved claim for compensation
  7. Contest filed claim not yet approved by WC Administrator
  8. Report payment, suspension or termination of benefit
  9. Notify the WC Administrator of worker’s return to work
